Care homes have a legal obligation under the statutory duty of care, the Health Act 2000 and the Hygiene Code 2006. This is about to change with the introduction of the Care Act 2008, a revised Hygiene Code and the new Care Quality Commission. The Health Act came into force for NHS care settings on 1st April 2009, and will become effective in all adult care settings in 2010/2011. The new Act focuses on actively reducing HCAIs for all care settings.
The time to prepare for the new Act is NOW. The 2008 Care Act encompasses Health and Safety, and infection control practices. Through the risk assessment process, implementation of policies and procedures, a documented system needs to be developed. This includes high level environmental hygiene practices, policies, procedures and chemicals, which through research and testing are proven to meet the needs of heath care sectors.
